Miller Sentenced To Up To 18 Years In State Prison

The Berkshire District Attorney’s Office successfully argued for a sentence above state guidelines in the case against Anthony Miller.

 Judge John Agostini sentenced the 51-year-old Miller to state prison for 12 to 18 years for aggravated rape. Agostini sentenced the Pittsfield man to concurrent time on charges of kidnapping, assault and battery with a dangerous weapon, assault and battery on a family or household member, and witness intimidation.

A Berkshire Superior Court jury found Miller guilty of the charges earlier this week. Miller severely beat, strangled, and raped the victim multiple times. He then prevented her from leaving the home.

The sentencing guideline calls for nine to 13 years in prison on the aggravated rape charge. Assistant District Attorney Megan Tesoniero argued for 18 to 20 years, citing Miller’s long criminal record of domestic violence. The defense asked for nine to 11 years.

Agostini determined that Miller’s violent history warranted going above state sentencing guidelines when ordering Miller to serve up to 18 years in state prison.

District Attorney Andrea Harrington said.

This was a horrific and violent assault by a man who has a long record of domestic violence. This sentence keeps a very dangerous person from hurting anybody else for a long time. I am proud of my office’s work on this case, of the Pittsfield Police Department for a great investigation, and of the victim for having the strength to relive that traumatic incident when testifying in court.
